Length of Stay in Canada (Visitor Visa)

Your visitor visa does not determine how long you can stay in Canada. The final decision is made by a Canadian border officer when you arrive.

Standard length of stay

Most visitors entering Canada are allowed:

Up to 6 months per visit
Counted from the day you enter Canada
Even if your visa is valid for years

Your visa expiry date only controls when you can enter Canada — not how long you can remain inside the country.

How it works

Visa validity ≠ Length of stay

Visa validity: The period during which you can enter Canada (e.g., valid until 2031)
Length of stay: How long you can remain in Canada after each entry (typically 6 months)

Why 6 months?

The 6-month standard applies to most visitors from all countries, not just specific nationalities. This is Canada's default visitor stay period unless:

The Canadian border officer at the port of entry (airport, land border, or seaport) has the authority to decide:

Default assumption

If the officer does not specify a different period, your stay is automatically 6 months from the date of entry.

⚠️ Officer's authority is final

The border officer's decision is binding. If they grant only 1 month, you must leave within 1 month or apply for an extension. You cannot argue at the border that you "deserve" 6 months.

Date stamp only: If only the entry date is stamped (no exit date written), you have 6 months from that date
Exit date written: If the officer writes a specific date, you must leave by that date (could be less than 6 months)
No stamp: Some travellers (e.g., US citizens) may not receive a stamp, but the 6-month rule still applies

Visitor record

Sometimes the officer issues a separate document called a Visitor Record (IMM 1097).

Shows the exact date you must leave Canada
Overrides the standard 6-month rule

⚠️ Check before leaving the airport

Always check your passport stamp and any documents given to you before leaving the port of entry. If you're unsure about your allowed stay period, ask the officer immediately. Do not assume you have 6 months.

Calculating your departure date

If you have 6 months:

Count 6 months from your entry date
Example: Enter March 15 → Must leave by September 15
The day you entered counts as day 1

If you have a visitor record:

The exact date is written on the document
This date is your legal deadline

Extending your stay

Can visitors extend their stay?

Yes. You can apply to extend your stay from inside Canada by requesting a visitor record.

When to apply

At least 30 days before your current status expires
Earlier is better (allows time for processing)
You can apply online or by paper
Do NOT wait until the last minute

Requirements

To extend your stay, you must show:

Valid passport: Must be valid for the duration of your extended stay

Overstaying consequences

Overstaying your authorized period is a serious immigration violation with long-term consequences.

What is overstaying?

You are overstaying if:

You remain in Canada after your 6-month period expires
You remain after the date on your visitor record
You remain after your extension application is refused
You don't leave when required by an immigration officer

Immediate consequences

Loss of status: You become "out of status" and are in Canada illegally
No extensions possible: Cannot apply to extend or change status from inside Canada

You cannot hide an overstay. Do not believe anyone who tells you "they won't know" or "it's fine." Canada shares immigration data internationally, and overstays have serious, documented consequences.

Pattern of living in Canada: Visiting for 5-6 months, leaving for 1-2 months, then returning for another 5-6 months looks like you're living in Canada
Officer concerns: Border officers may question whether you're truly a "visitor" or trying to live in Canada without proper status
Possible consequences: Denied entry, shortened stay period, or visa cancellation
